Drow is trademarked by TSR, now owned by Wizards of the Coast. Don't use it unless you enjoy lawsuits from nasty lawyers.

The Drow are a mythical creature... that would be like Microsoft tradmarking the name Hydra or Cerberus or Nereid....

Hey, don't give them any ideas.

You don't have to come up with original names for trademarks. O'Reilly has trademarked the camel for computers and RJ Reynolds Tobacco Company has trademarked it for their Camel cigarettes. You can trademark almost an image or word or string of letters provided nobody else has.

But that just means he can't use the camel cigarette logo... or it means he can't use the drow from the particular universe (same back story, same leaders, etc.) but he can definitely still have his own version of the Drow and use the name, they are from classical mythology which no one can "own"

It doesn't matter if the word is in the public domain or not. Once the trademark has been granted, trademark law is in effect. You can argue that the trademark was unfairly granted, but you will be arguing in court.

Or you can avoid the entire mess and call them something different, like the bæn siþe.

mythical creatures guide, is a reall gd site, have a look there.
