Bird of Prey in Enterprise !!!!!! (Spoilers)

I was asked this question the other day ?? How can the Klingons have birds of prey in Archers time ?

"Klingons do not get the Bird Of Preys until they STEAL the FIRST ONE from the Romulans! This happened to go on in the movie of Star Trek III. Klingons NEVER had Bird Of Preys of there own. They were belonging to Romulans FIRST! How can the Klingons have any? The Klingons should get none in the days of Archer on Enterprise."

Any Ideas ???

I've not seen enough episodes yet, do they have Birds of Prey? Only I read that there are going to be some new Klingon ships appearing in upcoming epiosdes, but that they ARE NOT Birds of Prey, but a completely different design entirely.... That's what I read!...I can't say for myself until I see them!

It seems that in the promo for "Sleeping Dogs" ENT, we catch a few glimpses of the Klingon Raptor-class scout ship, which looks like a small Vor'Cha cruiser. The problem appears not to be this ship design itself, but that in the dialog, they mention signaling Birds of Prey. Has anyone seen "Sleeping Dogs" yet?
